Q3. My landlord has threatened to evict me because I have rent arrears. My friend has told me not to worry as if I get evicted the council will have to re-house me.

A. If you have been evicted from your house intentionally, for example because you have not paid your rent, the council is not under a duty to offer you another house. It will then be up to you to find another house or you may become homeless. In order to evict you your landlord (e.g. City of Edinburgh Council, Housing Association or Private Landlord) must first obtain an order from the court. If you are threatened with eviction you should seek advice as soon as possible.
